I'm very likely the only Prosecuting Attorney in this thread. I can tell you from a legal standpoint, whether it's PA, IL or MO, that having someone call your Mom a whore doesn't give you the legal right to cold cock someone. You can defend yourself based on words of others in very limited circumstances. "I'm going to kill you" or "I'm going to beat the [shirt] out of you." Beyond that you are just being goaded into trouble and for us non hockey players you are so much better off either turning the other cheek or at least waiting until the other party makes the first move.

Now if there is evidence that the other guy made any kind of threatening move or gesture towards McKenna then all bets are off. Like I said upthread there is almost 100% chance this is going to be on video. Video is everywhere now. CCTV and phones. That should answer many questions.

The whore stuff will likely give him favorable public perception (see this thread and twitter) and it should help him get a reasonable plea deal. Down the road it is going to make anyone involved in a civil lawsuit (that is where this is for sure heading) more sympathetic to McKenna and make the victim look like a fool. Jurors in civil suits typically don't like that.

If this was my case I'm not going to go out of my way to hammer this Defendant but I'm not going to let him walk because somebody was calling his Mom names. Imagine that will be the position the DA's in PA take.

I do feel we have lost something in the modern world of limitless verbal assault. I am not sure there has been a time in all of human exitance where freedom to speak in any manner to another was without consequence.

I 100% agree with all of you as well. There are so many people that deserve a good pop in the nose. Just go to any airport. Within five minutes even the most passive will want to throttle someone.

I have plenty of discretion in most of my cases. I also don’t have to deal with the media often either. I really don’t want to speak for a DA in another state and we certainly don’t know all the facts yet. I still believe already this will be an easy plea for all sides.

If the part about his mom was true and she was present then i do t read it as easily provoked. I see it as standing up for who you love. That is a good team characteristic.

That really doesn't matter at all. Our decision should have nothing to do with agreeing with what he did or what others might do. It has to be all about maximizing our draft pick so the legal issues matter.
